Terms of Service

By accessing or using NEPSE ALERT ("the site," "we," "us"), you ("you," "user") agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the site. These terms apply to all visitors, registered users, and anyone who accesses any part of the site. Creating an account, or clicking to accept where prompted, constitutes a valid electronic acceptance of these terms under Nepal's Electronic Transactions Act, 2063 (2008), which gives legal recognition to electronic records and agreements.

You must be able to form a legally binding agreement to use the site. Under Nepal's National Civil Code, 2074 (2017), the age of majority is 18 years — if you are under 18, you should only use the site with the involvement and consent of a parent or guardian, and should not create an account or submit content without it. The site is not directed at children and is not intended for use by anyone under 18 without such involvement. If you are accessing the site from outside Nepal, you are also responsible for complying with the age and consent requirements of your own jurisdiction.

• You are responsible for maintaining the confidentiality of your account and for all activity under it.
• You agree to provide accurate information (including a valid email, required for every sign-in method) and to keep it up to date.
• We reserve the right to suspend or disable accounts that violate these terms, engage in abuse of shared resources (e.g. AI usage quotas), or are used for spam, fraud, or harassment.
• You must notify us promptly via Feedback if you become aware of any unauthorized use of your account.

By using the site, you agree not to:

• Use automated tools to scrape, overload, or abuse the site's AI features, APIs, or infrastructure.
• Post content in Discussion, comments, Community Analysis, Community Articles, or Feedback that is illegal, defamatory, harassing, or infringes on others' rights.
• Submit Community Analysis or Community Articles content that you did not create or do not have the right to share, or that is knowingly false or misleading about a stock, index, or company.
• Attempt to gain unauthorized access to other accounts, admin functions, or non-public parts of the site.
• Redistribute, resell, or scrape site content (analysis, data, or tools) for commercial purposes without permission.
• Impersonate any person or misrepresent your affiliation with anyone.
• Use the site to violate any applicable law, including the Electronic Transactions Act, 2063 (2008) and its cybercrime provisions.

Analysis, articles, tools, and site design are the property of Ananta Dhungana / NEPSE ALERT unless otherwise noted. You may share links to the site's content, but may not reproduce substantial portions of it elsewhere without permission. Content you submit (Discussion posts, comments, Wave Journal entries, Community Analysis, Community Articles) remains yours, but by posting publicly you grant us a non-exclusive, royalty-free license to display, moderate, and remove it on the site. We may review, edit for formatting, reject, or take down any user-submitted content at our discretion, including after publication, without prior notice.

If you believe content on the site (including a Community Analysis or Community Articles submission) infringes your copyright or other rights, contact us via Feedback with a description of the content, its location on the site, and your contact details. We will review and, where warranted, remove or disable access to the content.

Community Analysis and Community Articles are written and submitted by individual users, not by NEPSE ALERT or Ananta Dhungana, and reflect the views of that contributor alone. Admin review before publishing checks for basic relevance and acceptable use — it is not a verification of accuracy, and approval does not mean NEPSE ALERT endorses or guarantees any wave count, opinion, or claim made in that content. The same "not financial advice" disclaimer at the top of this page applies fully to all community-submitted content.

The Securities Board of Nepal (SEBON) regulates investment advisory, research, and analysis services in Nepal's securities market, and has publicly announced a "Zero Tolerance" policy toward insider trading, market manipulation, and misleading investment promotion — including from individuals and pages that publish stock recommendations on social media ("finfluencers") — alongside plans to introduce a formal licensing system and professional code of conduct for organizations and individuals offering investment advisory, research, and analysis services.

NEPSE ALERT and Ananta Dhungana are not a SEBON-licensed investment advisor, research analyst, portfolio manager, broker, or dealer, and do not hold any SEBON license to provide investment advisory or research services. All wave counts, signals, price targets, and other analysis published on the site — whether by Ananta Dhungana or by community contributors — are personal Elliott Wave / technical observations and opinions offered strictly for educational purposes. They are not, and must not be relied upon as, a recommendation, solicitation, or offer to buy, sell, or hold any security. We do not accept payment, commission, or any other compensation tied to a specific stock recommendation, and we do not manage funds, hold client assets, or execute trades on behalf of any user.

If you are unsure whether a decision requires licensed investment advice, or want to confirm SEBON's current rules on investment advisory and research services, consult SEBON directly at sebon.gov.np or a SEBON-licensed professional before acting.

AI Analyst tools (Fundamentals AI Analyst, SIP AI Analyst, Wave-I) generate responses using third-party AI providers based on historical/last-synced data. Responses may be incomplete, outdated, or incorrect — treat them as a starting point for your own research, never as investment instructions. Usage is subject to daily/rate limits to keep the shared free quota available for everyone.

The site, including all calculators, wave counts, signals, community-submitted content, and data, is provided "as is" and "as available" without warranty of any kind, express or implied. We do not guarantee the accuracy, completeness, timeliness, or continuous, uninterrupted, or error-free availability of any information, including market data, dividend history, fundamentals, or fee calculations — always verify with your broker or an official source before acting. We do not warrant that the site will be free of bugs, downtime, or security vulnerabilities.

To the fullest extent permitted by law, Ananta Dhungana and NEPSE ALERT shall not be liable for any direct, indirect, incidental, special, consequential, or punitive loss or damage — including trading/investment losses, lost profits, or loss of data — arising from your use of, or inability to use, the site, reliance on any content published on it (including community-submitted content), or any conduct of another user. This limitation applies regardless of the legal theory of liability and even if we have been advised of the possibility of such damages, to the extent permitted by Nepali law.

You agree to indemnify and hold harmless Ananta Dhungana and NEPSE ALERT from any claim, demand, loss, or liability (including reasonable legal fees) arising out of: your use of the site; content you submit (Discussion, comments, Community Analysis, Community Articles, Wave Journal); your violation of these terms; or your violation of any law or the rights of a third party.

The site relies on third-party services (Firebase, Vercel, AI providers, and others listed in our Privacy Policy). We are not responsible for the availability, performance, or content of these services, or of any external site linked from NEPSE ALERT.

We may suspend or terminate your access to the site at any time, with or without notice, for conduct that violates these terms or is otherwise harmful to the site or other users. You may stop using the site and delete your account at any time from Account Settings. Sections 5–13 of these terms survive termination of your account.

We may update these terms as the site evolves. Continued use of the site after changes are posted constitutes acceptance of the updated terms. Material changes will be reflected by updating the "Last updated" date above.

These terms, and any dispute arising from your use of the site, are governed by the laws of Nepal, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally (see Section 17, Contact) shall be subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal.

Questions, complaints, or disputes about these terms can be sent via the Feedback page. We will make reasonable efforts to resolve any concern informally before it becomes a formal dispute.

• Severability: if any provision of these terms is found unenforceable, the remaining provisions remain in full effect.
• Entire agreement: these terms, together with the Privacy Policy, constitute the entire agreement between you and NEPSE ALERT regarding use of the site, superseding any prior agreements.
• No waiver: our failure to enforce any provision is not a waiver of our right to do so later.
• Assignment: we may assign or transfer these terms in connection with a change in ownership or operation of the site; you may not assign your rights under these terms without our consent.
